A citizen can only be considered evading military service if they fail to fulfill the required obligations regarding data updates.
Nataliya Opolskaya, Doctor of Law and Head of the "Legal Bureau of Nataliya Opolskaya," provided clarifications on this matter.
She detailed the procedures outlined in the Regulations on Military Registration of Conscripts, Reservists, and Military Personnel, which stipulate that citizens must report to the district (city) TCSP or relevant authorities according to the instructions in official summonses, mobilization orders, or other documents. This process includes a requirement for undergoing a medical examination.
Opolskaya emphasized that the law mandates conscripts, reservists, and servicemen to report to military medical institutions as directed by the commissions. These commissions, responsible for assessing fitness for service, must issue referrals for medical examinations.
In her analysis, Opolskaya highlighted that the law does not require individuals to independently undergo medical examinations. Instead, the responsibility for directing individuals to the VMC for evaluation lies with the TCSP. The law is not violated only if the TCSP or the relevant authority does not send a conditionally fit conscript to the VMC after fulfilling their data update obligations.
Thus, as long as a person adheres to the legal requirements for data updates, and the authorities issue the appropriate referral, there are no violations.
