Nikolai Tishchenko, who was recently under round-the-clock house arrest, made an appearance at a session of the Verkhovna Rada. Focus has investigated the circumstances under which an arrested individual can move around the city and how this was possible for the deputy in question.

People's Deputy Nikolai Tishchenko, after being under round-the-clock house arrest until December 23, 2024, unexpectedly appeared at a session of the Verkhovna Rada on January 8, 2025. Even his health condition did not hinder him from getting back to work. Recall that at the end of December, the deputy allegedly fell ill right before a court session, and instead of being in the defendant's dock in Dnipro, Tishchenko found himself receiving IV treatment in a Kyiv hospital.

However, as we can see, the public servant is already feeling much better, as he arrived at the Rada and supposedly resumed his duties. At the very least, he has shifted the focus of his activities — the deputy announced a change in his stance regarding call centers. According to Tishchenko, he was against such companies because his constituents requested it. He then had time to reassess his position and changed his mind.

"You know, I have completely reconsidered. I had the opportunity to reflect, and I'm turning the pages. I realized that this struggle is unnecessary for anyone. I was doing this at the request of my voters," Tishchenko states in a video from the Rada hall.

The appearance of the people's deputy at the session was possible because on January 6, the court in Dnipro was supposed to consider the issue of extending the preventive measure for Nikolai Tishchenko. However, the session was postponed to January 10 due to a motion from the defense to disqualify the judge. Thus, the deputy has a few more days to spend time with his colleagues and record a video about his "reassessment of life."

Tishchenko Under House Arrest: When Can One Attend Work?

Considering that Tishchenko's preventive measure was simply not extended in time, his movements are quite understandable under the law.

However, lawyer of the legal company "Riyako&Partners" Ekaterina Anishchenko reminds us that if the court has imposed round-the-clock house arrest, the individual is not permitted to leave their residence without written permission from the investigator or the penal enforcement service. Such permissions are granted only in exceptional cases, for instance, in connection with the death of close relatives. The deputy could also request permission to fulfill his duties in the Verkhovna Rada.

During house arrest, the individual must wear an electronic bracelet that tracks their location. If any violations of the arrest conditions are recorded, the investigator may petition the court to change the preventive measure, for example, to detention in a pre-trial detention center.

Tishchenko — Case Details

Following the initiation of the criminal proceedings, the deputy was detained and placed under house arrest. Since then, he has not been allowed to leave his home or participate in sessions of the Verkhovna Rada in person. Meanwhile, footage was released, filmed near the home where the politician lives: he was seen walking, thus violating the terms of his preventive measure.
